International Data Transfer Mechanisms

International Data Transfer Mechanisms are framework that ensures personal data to be able to transferred from one country or region to another while maintaining adequate protection for the privacy and security of that data. These mechanisms are essential for facilitating global data flows while complying with data protection laws and regulations, such as the EU’s General Data Protection Regulation (GDPR). In Malaysia, international data transfers are governed primarily by the Personal Data Protection Act 2010 (PDPA).

The roles of PDPA includes:-

• Privacy Protection, to ensure any personal information sent outside of Malaysia is not misuses or shared without permission.
• Data usage controls, for any party who want to have private information must get permission before using it.
• Company rule setup, a certain rules must be followed to make sure the information are maintained secured.
• Own Rights management, where own information can be amended accordingly.
• Penalty enforcement, where punishments are implemented to those who breaks the law
